{"id":6080,"date":"2013-12-02T17:57:21","date_gmt":"2013-12-02T17:57:21","guid":{"rendered":"https:\/\/www.4ward4x4.com\/agb-2\/"},"modified":"2026-05-21T13:24:15","modified_gmt":"2026-05-21T13:24:15","slug":"terms-conditions","status":"publish","type":"page","link":"https:\/\/www.4ward4x4.com\/en\/terms-conditions\/","title":{"rendered":"AGB 4WARD4X4 Maintenance"},"content":{"rendered":"\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-bvjcn-e260a3a0e63628def4cfa1360d1cb997\">\n.flex_column.av-bvjcn-e260a3a0e63628def4cfa1360d1cb997{\nborder-radius:0px 0px 0px 0px;\npadding:0px 0px 0px 0px;\n}\n<\/style>\n<div class=\"flex_column av-bvjcn-e260a3a0e63628def4cfa1360d1cb997 av_one_full  avia-builder-el-0  avia-builder-el-no-sibling  first flex_column_div av-zero-column-padding  \"><section class=\"av_textblock_section av-kmewslyh-22dfcaeaca62a335cc47069581913e4d \" itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"><div class=\"avia_textblock\" itemprop=\"text\"><h2>General Terms and Conditions<\/h2>\n<p>4WARD4X4 Equipment<br>\nStephan Dennig<br>\nLiechtersmatten 10<br>\n77815 B&uuml;hl (Baden)<br>\nGermany<\/p>\n<p>(subsequently called 4WARD4X4)<\/p>\n<h2 data-start=\"622\" data-end=\"647\"><strong data-start=\"625\" data-end=\"647\">1. scope of application KFZ WERKSTATT<\/strong><\/h2>\n<ol data-start=\"648\" data-end=\"1029\">\n<li data-start=\"648\" data-end=\"806\">\n<p data-start=\"651\" data-end=\"806\">These GTC apply to all workshop, repair, maintenance, diagnostic, conversion and other technical services on vehicles by 4WARD4X4 Equipment.<\/p>\n<\/li>\n<li data-start=\"807\" data-end=\"908\">\n<p data-start=\"810\" data-end=\"908\">Deviating terms and conditions of the customer shall only apply if they have been expressly recognized in writing.<\/p>\n<\/li>\n<li data-start=\"909\" data-end=\"1029\">\n<p data-start=\"912\" data-end=\"1029\">Consumers and entrepreneurs shall be treated equally, provided there are no mandatory statutory provisions to the contrary.<\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"1031\" data-end=\"1034\">\n<h2 data-start=\"1036\" data-end=\"1061\"><strong data-start=\"1039\" data-end=\"1061\">2. conclusion of contract<\/strong><\/h2>\n<ol data-start=\"1062\" data-end=\"1429\">\n<li data-start=\"1062\" data-end=\"1171\">\n<p data-start=\"1065\" data-end=\"1171\">A contract for work is concluded by verbal, written, electronic or implied commissioning.<\/p>\n<\/li>\n<li data-start=\"1172\" data-end=\"1280\">\n<p data-start=\"1175\" data-end=\"1280\">Cost estimates are non-binding unless they are expressly marked as binding.<\/p>\n<\/li>\n<li data-start=\"1281\" data-end=\"1429\">\n<p data-start=\"1284\" data-end=\"1429\">Additional or extra work that is necessary for proper execution shall be deemed approved, provided that it is economically reasonable.<\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"1431\" data-end=\"1434\">\n<h2 data-start=\"1436\" data-end=\"1484\"><strong data-start=\"1439\" data-end=\"1484\">3. readiness for collection &amp; due date for payment<\/strong><\/h2>\n<ol data-start=\"1485\" data-end=\"1772\">\n<li data-start=\"1485\" data-end=\"1574\">\n<p data-start=\"1488\" data-end=\"1574\">Once the work has been completed, the customer is informed that the goods are ready for collection.<\/p>\n<\/li>\n<li data-start=\"1575\" data-end=\"1691\">\n<p data-start=\"1578\" data-end=\"1691\">Unless otherwise agreed, payment is <strong data-start=\"1633\" data-end=\"1650\">due immediately<\/strong> upon notification of readiness for collection.<\/p>\n<\/li>\n<li data-start=\"1692\" data-end=\"1772\">\n<p data-start=\"1695\" data-end=\"1772\">The vehicle will only be handed over after full payment has been received.<\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"1774\" data-end=\"1777\">\n<h2 data-start=\"1779\" data-end=\"1825\"><strong data-start=\"1782\" data-end=\"1825\">4. insolvency &amp; default of payment<\/strong><\/h2>\n<ol data-start=\"1826\" data-end=\"2317\">\n<li data-start=\"1826\" data-end=\"1972\">\n<p data-start=\"1829\" data-end=\"1972\">If the customer defaults on payment or expressly or impliedly declares his inability to pay, he shall be <strong data-start=\"1949\" data-end=\"1967\">in default of payment<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1973\" data-end=\"2197\">\n<p data-start=\"1976\" data-end=\"2025\">Insolvency exists in particular if:<\/p>\n<ul data-start=\"2029\" data-end=\"2197\">\n<li data-start=\"2029\" data-end=\"2083\">\n<p data-start=\"2031\" data-end=\"2083\">Invoices are not paid despite a deadline being set<\/p>\n<\/li>\n<li data-start=\"2087\" data-end=\"2119\">\n<p data-start=\"2089\" data-end=\"2119\">the customer cannot be reached<\/p>\n<\/li>\n<li data-start=\"2123\" data-end=\"2165\">\n<p data-start=\"2125\" data-end=\"2165\">Payment promises are not kept<\/p>\n<\/li>\n<li data-start=\"2169\" data-end=\"2197\">\n<p data-start=\"2171\" data-end=\"2197\">Chargebacks are made<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"2198\" data-end=\"2317\">\n<p data-start=\"2201\" data-end=\"2317\">The seller shall be entitled to claim further security and consequential costs from the time of default of payment.<\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"2319\" data-end=\"2322\">\n<h2 data-start=\"2324\" data-end=\"2390\"><strong data-start=\"2327\" data-end=\"2390\">5. demurrage (only in the event of insolvency \/ late payment)<\/strong><\/h2>\n<h3 data-start=\"2392\" data-end=\"2413\"><strong data-start=\"2396\" data-end=\"2413\">5.1 Principle<\/strong><\/h3>\n<p data-start=\"2414\" data-end=\"2536\">Demurrage will <strong data-start=\"2429\" data-end=\"2447\">only<\/strong> be charged if the customer is in <strong data-start=\"2480\" data-end=\"2526\">default of payment or insolvent<\/strong>.<\/p>\n<p data-start=\"2538\" data-end=\"2621\">A mere late collection without payment arrears <strong data-start=\"2602\" data-end=\"2620\">does not<\/strong> justify a <strong data-start=\"2602\" data-end=\"2620\">demurrage charge<\/strong>.<\/p>\n<hr data-start=\"2623\" data-end=\"2626\">\n<h3 data-start=\"2628\" data-end=\"2662\"><strong data-start=\"2632\" data-end=\"2662\">5.2 Start of the demurrage charge<\/strong><\/h3>\n<ol data-start=\"2663\" data-end=\"3011\">\n<li data-start=\"2663\" data-end=\"2904\">\n<p data-start=\"2666\" data-end=\"2700\">Stall fees will only be charged if:<\/p>\n<ul data-start=\"2704\" data-end=\"2904\">\n<li data-start=\"2704\" data-end=\"2742\">\n<p data-start=\"2706\" data-end=\"2742\">the vehicle is ready for collection <strong data-start=\"2735\" data-end=\"2742\">and<\/strong><\/p>\n<\/li>\n<li data-start=\"2746\" data-end=\"2779\">\n<p data-start=\"2748\" data-end=\"2779\">the invoice is due <strong data-start=\"2772\" data-end=\"2779\">and<\/strong><\/p>\n<\/li>\n<li data-start=\"2783\" data-end=\"2834\">\n<p data-start=\"2785\" data-end=\"2834\">the customer is in default of payment <strong data-start=\"2827\" data-end=\"2834\">and<\/strong><\/p>\n<\/li>\n<li data-start=\"2838\" data-end=\"2904\">\n<p data-start=\"2840\" data-end=\"2904\">the customer has been informed in writing of the demurrage obligation<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"2905\" data-end=\"3011\">\n<p data-start=\"2908\" data-end=\"3011\">The stand fee shall commence <strong data-start=\"2930\" data-end=\"3010\">at the earliest 14 calendar days after the written request for payment and collection.<\/strong><\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"3013\" data-end=\"3016\">\n<h3 data-start=\"3018\" data-end=\"3050\"><strong data-start=\"3022\" data-end=\"3050\">5.3 Amount of the demurrage charge<\/strong><\/h3>\n<p data-start=\"3051\" data-end=\"3073\">The stand fee is:<\/p>\n<blockquote data-start=\"3075\" data-end=\"3116\">\n<p data-start=\"3077\" data-end=\"3116\"><strong data-start=\"3077\" data-end=\"3116\">18.00 &euro; per calendar day incl. VAT. <\/strong><\/p>\n<\/blockquote>\n<p data-start=\"3118\" data-end=\"3145\">It serves to compensate for:<\/p>\n<ul data-start=\"3146\" data-end=\"3211\">\n<li data-start=\"3146\" data-end=\"3162\">\n<p data-start=\"3148\" data-end=\"3162\">Surface binding<\/p>\n<\/li>\n<li data-start=\"3163\" data-end=\"3183\">\n<p data-start=\"3165\" data-end=\"3183\">Custody risks<\/p>\n<\/li>\n<li data-start=\"3184\" data-end=\"3211\">\n<p data-start=\"3186\" data-end=\"3211\">additional operating expenses<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3213\" data-end=\"3216\">\n<h2 data-start=\"3218\" data-end=\"3277\"><strong data-start=\"3221\" data-end=\"3277\">6. right of retention &amp; contractor&rsquo;s lien<\/strong><\/h2>\n<ol data-start=\"3278\" data-end=\"3588\">\n<li data-start=\"3278\" data-end=\"3393\">\n<p data-start=\"3281\" data-end=\"3393\">The seller is entitled to retain the vehicle until all claims have been settled in full.<\/p>\n<\/li>\n<li data-start=\"3394\" data-end=\"3471\">\n<p data-start=\"3397\" data-end=\"3471\">There is a statutory <strong data-start=\"3425\" data-end=\"3470\">contractor&rsquo;s lien in accordance with &sect; 647 BGB<\/strong>.<\/p>\n<\/li>\n<li data-start=\"3472\" data-end=\"3588\">\n<p data-start=\"3475\" data-end=\"3509\">The lien extends to:<\/p>\n<ul data-start=\"3513\" data-end=\"3588\">\n<li data-start=\"3513\" data-end=\"3523\">\n<p data-start=\"3515\" data-end=\"3523\">Work wages<\/p>\n<\/li>\n<li data-start=\"3527\" data-end=\"3543\">\n<p data-start=\"3529\" data-end=\"3543\">Material costs<\/p>\n<\/li>\n<li data-start=\"3547\" data-end=\"3558\">\n<p data-start=\"3549\" data-end=\"3558\">demurrage<\/p>\n<\/li>\n<li data-start=\"3562\" data-end=\"3588\">\n<p data-start=\"3564\" data-end=\"3588\">Ancillary and default costs<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<hr data-start=\"3590\" data-end=\"3593\">\n<h2 data-start=\"3595\" data-end=\"3630\"><strong data-start=\"3598\" data-end=\"3630\">7. vehicles not collected<\/strong><\/h2>\n<ol data-start=\"3631\" data-end=\"3966\">\n<li data-start=\"3631\" data-end=\"3744\">\n<p data-start=\"3634\" data-end=\"3744\">If the vehicle is not collected despite a request for payment and collection, a final deadline may be set.<\/p>\n<\/li>\n<li data-start=\"3745\" data-end=\"3869\">\n<p data-start=\"3748\" data-end=\"3869\">If the deadline expires without result, the seller shall be entitled to dispose of the vehicle in accordance with the statutory provisions.<\/p>\n<\/li>\n<li data-start=\"3870\" data-end=\"3966\">\n<p data-start=\"3873\" data-end=\"3966\">Any proceeds from the sale will be offset against outstanding receivables. Any surplus is paid out. <\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"3968\" data-end=\"3971\">\n<h2 data-start=\"3973\" data-end=\"4013\"><strong data-start=\"3976\" data-end=\"4013\">8 Liability during safekeeping<\/strong><\/h2>\n<ol data-start=\"4014\" data-end=\"4240\">\n<li data-start=\"4014\" data-end=\"4101\">\n<p data-start=\"4017\" data-end=\"4101\">During the standstill period, the seller shall only be liable for intent and gross negligence.<\/p>\n<\/li>\n<li data-start=\"4102\" data-end=\"4240\">\n<p data-start=\"4105\" data-end=\"4131\">No liability exists for:<\/p>\n<ul data-start=\"4135\" data-end=\"4240\">\n<li data-start=\"4135\" data-end=\"4146\">\n<p data-start=\"4137\" data-end=\"4146\">Theft<\/p>\n<\/li>\n<li data-start=\"4150\" data-end=\"4163\">\n<p data-start=\"4152\" data-end=\"4163\">Vandalism<\/p>\n<\/li>\n<li data-start=\"4167\" data-end=\"4188\">\n<p data-start=\"4169\" data-end=\"4188\">Weather influences<\/p>\n<\/li>\n<li data-start=\"4192\" data-end=\"4240\">\n<p data-start=\"4194\" data-end=\"4240\">force majeure<br data-start=\"4207\" data-end=\"4210\">to the extent permitted by law.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<hr data-start=\"4242\" data-end=\"4245\">\n<h2 data-start=\"4247\" data-end=\"4270\"><strong data-start=\"4250\" data-end=\"4270\">9. liability for defects<\/strong><\/h2>\n<p data-start=\"4271\" data-end=\"4351\">The statutory provisions of the law on contracts for work and services (&sect;&sect; 634 ff. BGB) shall apply.<\/p>\n<hr data-start=\"4353\" data-end=\"4356\">\n<h2 data-start=\"4358\" data-end=\"4402\"><strong data-start=\"4361\" data-end=\"4402\">10 Applicable law &amp; place of jurisdiction<\/strong><\/h2>\n<ol data-start=\"4403\" data-end=\"4547\">\n<li data-start=\"4403\" data-end=\"4430\">\n<p data-start=\"4406\" data-end=\"4430\">German law applies.<\/p>\n<\/li>\n<li data-start=\"4431\" data-end=\"4507\">\n<p data-start=\"4434\" data-end=\"4507\">The place of jurisdiction is &ndash; as far as legally permissible &ndash; the registered office of the seller.<\/p>\n<\/li>\n<li data-start=\"4508\" data-end=\"4547\">\n<p data-start=\"4511\" data-end=\"4547\">Consumer rights remain unaffected.<\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"4549\" data-end=\"4552\">\n<h2 data-start=\"4554\" data-end=\"4586\"><strong data-start=\"4557\" data-end=\"4586\">11. severability clause<\/strong><\/h2>\n<p data-start=\"4587\" data-end=\"4689\">Should individual provisions be invalid, this shall not affect the validity of the remaining provisions.<\/p>\n<\/div><\/section><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-6080","page","type-page","status-publish","hentry"],"_links":{"self":[{"href":"https:\/\/www.4ward4x4.com\/en\/wp-json\/wp\/v2\/pages\/6080","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.4ward4x4.com\/en\/wp-json\/wp\/v2\/pages"}],"about":[{"href":"https:\/\/www.4ward4x4.com\/en\/wp-json\/wp\/v2\/types\/page"}],"author":[{"embeddable":true,"href":"https:\/\/www.4ward4x4.com\/en\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/www.4ward4x4.com\/en\/wp-json\/wp\/v2\/comments?post=6080"}],"version-history":[{"count":2,"href":"https:\/\/www.4ward4x4.com\/en\/wp-json\/wp\/v2\/pages\/6080\/revisions"}],"predecessor-version":[{"id":12937,"href":"https:\/\/www.4ward4x4.com\/en\/wp-json\/wp\/v2\/pages\/6080\/revisions\/12937"}],"wp:attachment":[{"href":"https:\/\/www.4ward4x4.com\/en\/wp-json\/wp\/v2\/media?parent=6080"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
